Terms of Service

1.Agreement to terms

These Terms of Service ("Terms") govern your use of CheckPod, a digital compliance application operated by Traction Solutions Ltd (Company No. 17075841), registered in England and Wales ("we", "us", "our").

By creating an account or using CheckPod, you agree to be bound by these Terms. If you do not agree, do not use the service.

These Terms apply to all CheckPod subscription plans.

2.The CheckPod service

CheckPod is a Progressive Web Application (PWA) that provides:

• GOV.UK compliant digital HGV walkaround checks
• Proof of delivery with GPS location, photo capture and digital signature
• Roadside defect reporting with photo evidence
• PDF export of records
• Fleet management dashboard (Fleet plans)

3.Accounts and eligibility

To use CheckPod you must:

• Be at least 18 years of age
• Be a professional driver or transport manager operating in the United Kingdom
• Provide accurate and complete registration information
• Maintain the security of your account credentials

You are responsible for all activity that occurs under your account. Notify us immediately at support@checkpod.co.uk if you suspect unauthorised access.

We reserve the right to suspend or terminate accounts that violate these Terms.

4.Subscriptions and payment

CheckPod is provided on a subscription basis. The plans available, their features and their prices are displayed at the point of sign-up and on our website. The price applicable to your subscription is the price shown to you at the point of purchase.

All prices are inclusive of any applicable taxes. Traction Solutions Ltd is not currently VAT registered. Payments are processed securely by Stripe. Your subscription renews automatically at the end of each billing period until cancelled.

We reserve the right to change pricing with 30 days notice. Existing subscribers will be notified by email before any price change takes effect, and may cancel before the change applies.

5.Free trial

New accounts are eligible for a 7-day free trial with full access to all features of the selected plan. No payment card is required to start a trial.

At the end of the trial period, continued use requires a paid subscription. If you do not subscribe, access to the service will cease and your data will be retained for 30 days before deletion.

One free trial per person. We reserve the right to end or modify the free trial offer at any time.

6.Cancellation and refunds

You may cancel your subscription at any time through the billing portal within the app, or by contacting us at support@checkpod.co.uk.

Cancellation takes effect at the end of the current billing period. You will retain full access until that date. We do not offer partial refunds for unused time within a billing period.

Annual subscriptions: if you cancel within 14 days of your initial purchase and have not used the service, you are entitled to a full refund under the Consumer Contracts Regulations 2013. After 14 days, no refund is available for the remaining period.

Monthly subscriptions: no refund for the current month; cancellation takes effect at next renewal.

7.Acceptable use

You agree not to use CheckPod to:

• Submit false, misleading or fraudulent records
• Impersonate another person or misrepresent your identity
• Attempt to gain unauthorised access to other users' accounts or data
• Interfere with or disrupt the service or its infrastructure
• Use the service for any unlawful purpose
• Attempt to reverse engineer, copy or redistribute any part of the service

Violation of these terms may result in immediate account suspension without refund.

8.Your data

You retain ownership of all records and data you create within CheckPod. We process your data as a data processor on your behalf in accordance with our Privacy Policy.

You are responsible for ensuring that any personal data you submit about third parties (such as delivery recipients) is collected and processed lawfully.

You can export your data as PDF at any time within the app. Upon account closure, we will delete your data within 30 days upon request, subject to our legal retention obligations.

9.Service availability

We aim to provide a reliable service but do not guarantee 100% uptime. Scheduled maintenance will be communicated in advance where possible.

CheckPod is designed to work offline. Core functionality (completing checks, recording deliveries) is available without an internet connection. Data syncs when connectivity is restored.

We are not liable for any losses arising from service unavailability, data loss or technical failures beyond our reasonable control.

10.Limitation of liability

To the maximum extent permitted by UK law, Traction Solutions Ltd shall not be liable for:

• Any indirect, incidental or consequential losses
• Loss of data, profit or business opportunity
• Any fines, penalties or regulatory action arising from your use of the service
• Any claim arising from your reliance on CheckPod records as evidence of compliance

Our total liability to you in any calendar year shall not exceed the total subscription fees paid by you in that year.

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or for fraudulent misrepresentation.

11.Termination

We may suspend or terminate your account immediately if you breach these Terms, fail to pay subscription fees, or if we are required to do so by law.

You may terminate your account at any time by cancelling your subscription and contacting us to request account deletion.

Upon termination, your right to use the service ceases immediately. We will retain your data for 30 days before deletion, giving you time to export any records you need.

12.Governing law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, you may also have rights under the laws of your country of residence that cannot be excluded by this clause.

13.Changes to these terms

We may update these Terms from time to time. When we make material changes, we will notify you by email at least 14 days before the changes take effect. Your continued use of CheckPod after that date constitutes acceptance of the updated Terms.

If you do not accept the updated Terms, you may cancel your subscription before they take effect.
